Please read these terms and conditions carefully, as they affect your legal rights. Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Website. If you do not agree to be bound by these terms and conditions, you should stop using the Website immediately.

Purchases and Online Commerce

9. Sections of the Website, the affiliated site https://members.foodphotographyacademy.co, or their content, may allow you to make purchases from us for our Membership Academy, affiliated Products and / or Services. If paying by debit card, or credit card, you give us permission to automatically charge your credit or debit card as payment for your access to Food Photography Academy, Products and / or Services without any additional authorization, for which you will receive an electronic receipt.

9.1 Food Photography Academy is a subscription based service. By subscribing to Food Photography Academy, you will be set up with a recurring billing account, and you can view your “next billing date” in the “My Account” page of the website, under the subscriptions tab.

9.2 By subscribing to Food Photography Academy, your subscription will be auto-renewed at the end of your billing cycle unless you pause or cancel your subscription from within the “My Account” page of the website.

10. In the event that payment is not received by the date due, you will have a fifteen (15) day grace period to make the payment, otherwise we reserve the right to cease your access to Food Photography Academy, Products and / or Services immediately and permanently.

11. If you voluntarily decide to withdraw from Food Photography Academy within the period stated in our clear and explicit Refund Policy in these Terms and Conditions of Use, you must follow the terms of the Refund Policy in order for your payment(s) made within the period of our Refund Policy to be refunded.

12. If you fail to make payment in a timely manner in accordance with these Terms and Conditions of Use or voluntarily decide to withdraw from Food Photography Academy outside of the terms of the Refund Policy, you still will remain fully responsible for the full cost of the Membership.

13. You agree to only purchase goods or services for yourself or for another person for whom you are legally permitted to do so or for whom you have obtained the express consent to provide their name, address, method of payment, credit card number, and billing information.

14. Since we have a clear and explicit Refund Policy in these Terms and Conditions of Use that you have agreed to prior to completing the purchase of any of our Courses, we do not tolerate or accept any type of chargeback threat or actual chargeback from your credit card company.

14.1 Trial Periods. If you enter a free or paid trial of Food Photography Academy, you will automatically be charged at the end of that trial period to continue with your membership (with whatever terms you signed up with). If you do not want to continue, you need to cancel your subscription during the trial period. Doing so will mean that you will not be charged at the end of the trial, and your access will be removed when the trial period expires. Please note that trial periods are included in the 30 day period as stated in our refund policy. Trials are only available once per customer, if you previously joined a membership level with a trial, you will not be able to do a second trial on the same membership level.


Refund Policy

15. We offer a 30-Day refund policy for any subscription to Food Photography Academy. You may request a refund for up to 30 days after you purchase the course. No exceptions will be made.

15.1. The Food Photography Business Mastermind is non-refundable once the Mastermind begins. The start date of the Mastermind will be communicated to you upon enrollment to the Mastermind.

16. To be eligible for a refund, you must submit your request to support@foodphotographyacademy.co within 30 days of purchasing the membership.

17. No refunds will be provided after 30 days following the start of the Membership Subscription (including any trial period).

Cancellation Policy

18. You can cancel your membership any time from within your account. Your membership status will be updated automatically at the end of your billing cycle, and you will retain access to Food Photography Academy until the end of the billing cycle.

Pausing Subscriptions

18.1 It is possible to pause a monthly subscription. Annual subscriptions cannot be paused. You can pause your subscription any time from within your account, for up to 6 months. After 6 months, your subscription will be automatically cancelled. The purpose of pausing is to avoid making your next payments on your subscription, so that you can resume payments at a later date. When pausing your subscription, you will retain access to Food Photography Academy until the end of your billing cycle. After this point, your subscription will become inactive (you will no longer have access to the content in the academy), and you can choose to resume your membership at any time, for up to 6 months.

18.2 How the resuming of your subscription works, depends on whether you purchased with Stripe or with Paypal.

18.2.1 If you purchased with Stripe:
When resuming after your subscription has become inactive, you will be immediately reactivated and billed on the day that you resume your subscription. All future billings will happen on that new day. 
For example: If you have a monthly subscription that normally bills on the 1st of the month, and you pause your monthly subscription on the 15th, your account will become inactive from the 1st of the next month. If you then resume on the 10th of the next month, you will be billed that day, and your new bill date will be every 10th of the month.

18.2.2 If you purchased a monthly subscription with PayPal:
When resuming after your subscription has become inactive, you will only be reactivated and billed when the next original billing date occurs.
For example: If you have a monthly subscription that normally bills on the 1st of the month, and you pause your monthly subscription on the 15th, your account will become inactive from the 1st of the next month. If you then resume on the 10th of the next month, your account will remain inactive until the 1st of the next month, at which point your billing will resume again on every 1st of the month.

Availability of the Website and Disclaimers

19. Any online facilities, tools, services or information that Lauren Short trading as Short Media Enterprises makes available through the Website (the Service) is provided “as is” and on an “as available” basis. We give no warranty that the Service will be free of defects and/or faults. To the maximum extent permitted by the law, we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality. Lauren Short trading as Short Media Enterprises is under no obligation to update information on the Website.

20. Whilst Lauren Short trading as Short Media Enterprises uses reasonable endeavours to ensure that the Website is secure and free of errors, viruses and other malware, we give no warranty or guaranty in that regard and all Users take responsibility for their own security, that of their personal details and their computers.

21. Lauren Short trading as Short Media Enterprises accepts no liability for any disruption or non-availability of the Website.

22. Lauren Short trading as Short Media Enterprises reserves the right to alter, suspend or discontinue any part (or the whole of) the Website including, but not limited to, any products and/or services available. These terms and conditions shall continue to apply to any modified version of the Website unless it is expressly stated otherwise.

Limitation of Liability

23. Nothing in these terms and conditions will: (a) limit or exclude our or your liability for death or personal injury resulting from our or your negligence, as applicable; (b) limit or exclude our or your liability for fraud or fraudulent misrepresentation; or (c) limit or exclude any of our or your liabilities in any way that is not permitted under applicable law.

24. We will not be liable to you in respect of any losses arising out of events beyond our reasonable control.

25. To the maximum extent permitted by law, Lauren Short trading as Short Media Enterprises accepts no liability for any of the following:

a) any business losses, such as loss of profits, income, revenue, anticipated savings, business, contracts, goodwill or commercial opportunities;

b) loss or corruption of any data, database or software;

26. You may not transfer any of your rights under these terms and conditions to any other person. We may transfer our rights under these terms and conditions where we reasonably believe your rights will not be affected.

27. These terms and conditions may be varied by us from time to time. Such revised terms will apply to the Website from the date of publication. Users should check the terms and conditions regularly to ensure familiarity with the then current version.

28. These terms and conditions together with the Privacy Policy contain the whole agreement between the parties relating to its subject matter and supersede all prior discussions, arrangements or agreements that might have taken place in relation to the terms and conditions.

If any court or competent authority finds that any provision of these terms and conditions (or part of any provision) is invalid, illegal or unenforceable, that provision or part-provision will, to the extent required, be deemed to be deleted, and the validity and enforceability of the other provisions of these terms and conditions will not be affected.

30. Unless otherwise agreed, no delay, act or omission by a party in exercising any right or remedy will be deemed a waiver of that, or any other, right or remedy.

31. This Agreement shall be governed by and interpreted according to the law of Switzerland and all disputes arising under the Agreement (including non-contractual disputes or claims) shall be subject to the exclusive jurisdiction of the Swiss courts.
